These Terms and Conditions govern the use of the Actimath platform (actimath.com), including both free and paid features.
The platform is currently operated by Satwik Vasuki, an individual proprietor carrying on business under the trade name Darfun Labs ("we," "our," or "us").
We may assign or transfer these Terms and the operation of the Actimath business to a successor entity formed to operate the platform. Continued use of the platform following such transfer shall constitute acceptance of the updated operating entity.
By creating an account, purchasing a subscription, or using Actimath, you agree to be bound by these Terms.

Eligibility
Accounts may be created only by individuals aged 18 years or older.
Where Actimath is used within an institution, the account holder represents that they have authority to act on behalf of that organization and are responsible for supervising student participation.

Description of Service
Actimath is a web-based educational platform that uses motion tracking and computer vision to enable interactive math-based physical activities.
The platform is intended as a supplemental engagement tool and does not replace formal instruction.

License to Use the Platform
Subject to these Terms, we grant a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the platform solely for internal educational or institutional purposes within the licensed facility.
Users may not:
- copy, reproduce, distribute, or publicly commercialize the platform
- reverse engineer or attempt to extract source code
- create derivative works
- transfer, sublicense, resell, or assign platform access
All intellectual property rights remain our exclusive property.
Users may not assign or transfer their rights under these Terms without our prior written consent.

Physical Activity, Medical Disclaimer, and Safety
Actimath requires physical movement such as jumping, reaching, and lateral motion.
Medical Disclaimer
The platform provides educational activity software only and does not provide medical advice, diagnosis, or treatment.Assumption of Risk
Use of the platform involves inherent physical risks. Users voluntarily assume all such risks.Responsibility for Environment
The supervising adult or institution is solely responsible for ensuring that the activity environment is safe, participants are adequately supervised, and participants are medically fit for physical activity. We provide software only and do not control physical environments. -
No Warranty
The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of fitness for a particular purpose, availability, accuracy, or non-infringement.

Limitation of Liability
To the fullest extent permitted by law, Darfun Labs (including its proprietor, employees, contractors, and successor entities) shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
This includes damages arising from:
- physical injuries
- unsafe activity environments
- service interruptions
- data loss
- technical errors
- loss of revenue or institutional disruption
Total liability shall not exceed the amount paid by the user for the service during the twelve (12) months preceding the claim.

Disclaimer of Educational Outcomes
We do not guarantee improvements in academic performance, learning outcomes, or test scores. Educational effectiveness depends on supervision, instruction quality, and participant engagement.

Account Responsibility
Users are responsible for:
- safeguarding login credentials
- maintaining accurate registration information
- all activities conducted under their account
Unauthorized use must be reported promptly.

Subscriptions and Payments
Certain features require a paid subscription or institutional license. Payments may be processed through third-party gateways including UPI systems.
Pricing, duration, and applicable taxes (such as GST) will be communicated at checkout or account provisioning.

Cancellation and Refund Policy
Refunds and cancellations are governed by our Refund Policy. Key conditions are summarized below.
Because a free tier allows users to evaluate platform compatibility prior to purchase, subscription purchases are generally final and non-refundable except where required by applicable law.
Refunds may be considered in limited cases such as duplicate payments or technical failure preventing activation. Requests must be submitted within 7 days of the transaction.
Approved refunds will be processed using a method determined at our discretion within a reasonable processing period.
Subscriptions do not auto-renew and will revert to the free tier upon expiry.

Account Suspension or Termination
We may suspend or terminate accounts that:
- violate these Terms
- misuse the platform
- create safety risks
- interfere with system security
- fail to meet payment obligations
- breach applicable law
Termination may result in loss of access to subscription features.

Service Availability and Force Majeure
We aim to maintain reliable access but do not guarantee uninterrupted service. We are not liable for performance delays caused by events beyond reasonable control, including natural disasters, infrastructure failures, connectivity disruptions, or government actions.

Indemnification
Users agree to indemnify and hold harmless Darfun Labs from claims, damages, liabilities, or expenses arising from:
- use of the platform
- unsafe activity environments
- negligence or breach of law by the user
- violation of these Terms
- infringement of third-party rights

Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Disputes shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka.

Entire Agreement and Severability
These Terms together with the Privacy Policy constitute the complete agreement governing platform use. If any provision is found unenforceable, remaining provisions shall continue in full effect.
